Send via Electronic Payment Provider

1. Acceptance of the Terms of Service

By using the send functionality with electronic payment providers ("third-party sends"), the User accepts these Terms and Conditions. If the User does not agree with them, the User shall not use the Service.

2. Definitions

For purposes of these Terms and Conditions, the following terms shall have the meanings set forth below:

  • El Dorado / the Platform: El Dorado's App or Web App, in accordance with the General Terms and Conditions.
  • Electronic Payment Provider: an entity authorized to receive and process digital assets and to settle fiat currency, whose integration within the Platform allows the User to sell USDT through the functionality described in these Terms and Conditions.
  • Service: the "third-party sends" functionality in its sale of digital assets modality (Off-Ramp), as described in these Terms and Conditions.
  • USDT: Tether, a stable-value digital asset (stablecoin) issued on blockchain, which constitutes the asset to be sold through the Service.
  • Fiat Currency / Fiduciary Currency: legal-tender money issued by a central bank or monetary authority, which the User shall receive as consideration for the sale of USDT.
  • Off-Ramp: a transaction whereby the User transfers USDT to the Electronic Payment Provider from the User's El Dorado wallet and receives, in exchange, fiat currency through the selected payment method.
  • Payment Method / Payment Instrument: a financial instrument enabled in the country where the User wishes to operate, into which the fiat currency resulting from the sale of USDT shall be credited. The payment method may belong to the User or to a third party designated by the User, as set forth in Section 7 of these Terms and Conditions.
  • Third Party: a natural person designated by the User to receive the fiat currency resulting from the transaction.

3. Description of the Service

"Third-party sends" in its Off-Ramp modality is an El Dorado functionality that allows Users to sell USDT for fiat currency through the Electronic Payment Provider, according to the parameters entered, including, but not limited to, the fiduciary currency, the amount, and the selected payment method. The options available to the User are those described in Section 6 of these Terms and Conditions.

El Dorado makes its platform available solely to facilitate access to the Service. El Dorado does not participate in the fiat payment operation, does not perform currency exchanges, does not receive fiduciary money directly from Users, and is not an authorized exchange agent. The price displayed in the application for the purchase of fiat currency corresponds to the rate of the Electronic Payment Provider. In any case, such price may vary at the time the order is initiated. It is the User's responsibility to verify the price before confirming the transaction.

4. Availability

This functionality shall be available exclusively in the countries and fiat currencies determined by El Dorado and the Electronic Payment Provider for such purpose, the fiat currencies being those in which the User may receive the consideration for the sale of USDT in accordance with these Terms and Conditions. Both conditions shall be communicated in due time through the Platform; El Dorado reserves the right to expand, modify, suspend, or restrict them at any time and without prior notice, for operational, regulatory, compliance, or security reasons.

5. Eligibility

The Service shall be available through the "Send" and "Exchange" options within the Platform. Access to the Service and the options available shall be provided as described in Section 6 of these Terms and Conditions.

To access the Service, the User must be of legal age, have an active wallet in El Dorado with the KYC verification level required for each operation, which can be consulted through the following link: https://eldorado.io/legal/anexxes/annex-b, and have USDT available in the User's El Dorado wallet to carry out the transaction.

6. Operation

The experience within the Service shall function as follows:

6.1. Users may access both the Electronic Payment Provider's service and the offers from merchants available in the Platform's P2P order book. The Platform shall display the Electronic Payment Provider alongside the P2P merchant alternatives for the User to choose from. The Electronic Payment Provider shall be identified within the Platform as the automatic-processing option, and it shall be entirely the User's decision which one to take. In the event that the User chooses the Electronic Payment Provider's offer and the User is at KYC verification level 1, the User must mandatorily complete the verification process to level 2 (standard KYC) in order to continue with the operation.

The simultaneous availability of both options shall be subject to the operational conditions of the Platform at any given time, and El Dorado does not guarantee that both will always be presented to the User.

The price displayed for each option is for reference and may vary at the time the order is initiated. It is the User's responsibility to verify the price of the selected option before confirming the transaction.

6.2. In countries where El Dorado does not have the active P2P alternative (which operates based on the offers of merchants available in the Platform's order book) for this functionality, the User shall operate exclusively through the Electronic Payment Provider.

7. Payment Method

The payment methods enabled to receive the consideration in fiat currency for the sale of USDT shall correspond to the country and fiat currency that El Dorado enables for such purpose.

The User may use a payment method owned by the User or by a third party, which must be expressly indicated by the User within the Platform at the time of selecting the payment method for the receipt of fiat currency.

Should the User provide a third-party payment method, the User represents and warrants that the associated data is true, complete, and up-to-date, and assumes full responsibility for any error or omission in such information. Likewise, the User represents that the third party whose payment method is designated is not involved in money laundering or terrorist financing activities, is not subject to international sanctions, and does not hold the status of a Politically Exposed Person (PEP), and shall hold El Dorado harmless from any claim, sanction, or damage that may arise from breach of this representation. El Dorado shall not be liable for transactions credited to incorrect payment methods as a result of erroneous data provided by the User.

El Dorado reserves the right to modify, at any time and at its sole discretion, the payment methods enabled on the Platform for each country. Such modifications shall be duly communicated through the Platform, and it shall be the User's exclusive responsibility to consult, review, and verify such information before carrying out any operation.

8. Operational Limits

The monthly limit per User for operations through the Electronic Payment Provider shall be five thousand USDT (5,000 USDT) for each thirty (30) calendar-day period. To carry out payments that exceed this threshold, the User must complete information that allows for enhanced due diligence, which shall be evaluated by El Dorado's compliance team.

The approval of any increase shall be subject to the assessment of the Electronic Payment Provider at its sole discretion, with no obligation to grant such increase.

9. Monitoring

Operations carried out through this functionality are subject to internal monitoring. In the event of alerts, unusual behavior, or for operational or regulatory needs, El Dorado may require additional information from the User before processing or releasing a transaction.

The User undertakes and is obliged to address such request in a timely manner and within the terms indicated by El Dorado.

10. User Responsibilities

The User is responsible for verifying that the data entered in each transaction, including the data of the designated third party's payment method, is correct before confirming any operation. The User undertakes to use the functionality exclusively with funds of lawful origin and not to use it for activities that contravene applicable law.

The User represents and warrants that the information provided within the framework of the Service, including that of the designated third-party payment method, is true, complete, and up-to-date. Breach of this obligation releases El Dorado from any liability arising from the operation and may result in the immediate suspension of the Service, the withholding of funds, and the exercise of the corresponding legal actions.

11. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Panama.

12. Dispute Resolution

Where a dispute arises between the User and El Dorado in connection with this functionality, the same shall be subject to the procedure established in the General Terms and Conditions of the Platform.

13. Petitions, Complaints, and Claims

The User may submit petitions, complaints, claims, disputes, or suggestions relating to this Service through the support channels enabled by El Dorado. Requests must be sent clearly and with the information necessary to allow their proper review. El Dorado shall review each request in good faith and shall provide a response within fifteen (15) business days following receipt thereof. The filing of a petition, complaint, or claim does not suspend the application of these Terms and Conditions or the General Terms and Conditions of the Platform.

16. Modifications to the Terms

Any modification, update, or adjustment to the conditions of the Service shall be notified to the User in a timely manner through the application. The User accepts and acknowledges that it is the User's responsibility to periodically review the application to be aware of such changes. Continued use of this Service, or express acceptance within the application, shall be understood as full and binding acceptance of the new conditions of the Service.
