Golden Captains Program

1. Purpose of the Program

The “Golden Captains” Program (hereinafter, the “Program”) aims to incentivize the acquisition and activation of new users on the El Dorado platform, with a special focus on high-value users—including, but not limited to, migrant communities—through a system of economic rewards granted to individuals who, as Golden Captains, refer and promote the registration and use of the platform. Participation in the Program implies full and unreserved acceptance of these Terms and Conditions.

2. Definitions

The following definitions will help you more easily understand these Terms and Conditions:

  • Platform: The El Dorado App through which users access services and the Golden Captains Program.
  • Golden Captain: A natural person of legal age who holds an active and verified account on the Platform and who has been authorized by El Dorado to participate in the Program to acquire new users through their Acquisition Code.
  • Acquired User: A natural person who registers on the El Dorado Platform for the first time using a valid Acquisition Code issued by a Golden Captain.
  • Acquisition Code: A unique identifier assigned to the Golden Captain, associated with their username, which allows for the tracking of the registration and activity of Acquired Users. The code is available in the User's profile.
  • Valid Transaction: An operation effectively completed by the Acquired User within the Platform under the terms defined in Section 8 of these Terms and Conditions.
  • Reward: An economic benefit granted in USDT to the Golden Captain once the Program conditions are met.
  • Settlement Period: The calendar month for which the Rewards earned by the Golden Captain are calculated, subject to payment in the immediately following month pursuant to Section 10.

3. Validity and Program Periods

The Program will operate for indefinite periods. El Dorado may establish specific conditions applicable to the Program, including but not limited to:

  • The Reward amount for Acquired User registration.
  • The Reward amount for a Valid Transaction by the Acquired User.
  • The conditions necessary to unlock and settle Rewards.
  • Monthly or total caps applicable to the Golden Captain.
  • The duration of the Program.

Regardless of the above, the defined conditions will remain in effect and fully applicable until El Dorado publishes a new modification, update, or version of the Program, whether for a new period or of a general nature. The applicable conditions shall be those in force at the time the Reward is earned. Any modification will be communicated in a timely manner through the Platform or via the contact channels registered by the Golden Captain. The Golden Captain acknowledges that it is their exclusive responsibility to periodically review such updates, and that continued participation in the Program will constitute full and binding acceptance of the new conditions.

4. Promotional Nature and Scope of the Program

The Golden Captains Program is promotional and voluntary. Participation in it does not constitute an acquired right, nor does it imply the existence of an employment, commercial, agency, mandate, partnership, representation relationship, or any bond other than what is agreed upon herein between the Golden Captain and El Dorado. The Golden Captain acts on their own behalf, exclusively assuming the costs, taxes, contributions, withholdings, and other fiscal obligations that may derive from the Rewards received, and releases El Dorado from any liability in this regard. The availability of the Program, as well as the granting and settlement of Rewards, will be subject to compliance with these Terms and Conditions.

5. Eligibility

Individuals who concurrently meet the following requirements may participate in the Golden Captains Program:

  • Be a natural person of legal age.
  • Have an active and duly verified account (KYC) on the Platform, authorized to operate at verification level L1 or any subsequent levels, in accordance with Annex B of the Platform's Terms and Conditions.
  • Comply with the operational and usage conditions established by El Dorado.
  • Not be subject to restrictions, blocks, sanctions, or investigations for non-compliance with the Platform's terms and conditions or applicable regulations. El Dorado reserves the right to approve, reject, or revoke the status of Golden Captain at its discretion, without this giving rise to any right to compensation.

6. Acquisition Code

The Acquisition Code corresponds to the referral code available to the User in the Profile section within the Platform. The Acquisition Code may be freely shared by the Golden Captain under the conditions of this Program, without implying the existence of an employment, commercial, agency, or representation relationship with El Dorado.

7. Code Entry by the Acquired User

The Acquired User may enter the Acquisition Code at any of the following moments:

  • During the registration process, at the onboarding stage, after phone number verification and entry of first and last name.

8. Incentive Structure and Conditions for Earning Rewards

The Golden Captain may earn Rewards according to the following incentive scheme: a. Registration Reward For each Acquired User who registers on the Platform using a valid Acquisition Code and completes the KYC verification process up to level L1, the Golden Captain will earn a Reward of USDT 1. b. Valid Transaction Reward Additionally, if the Acquired User performs at least one Valid Transaction within the Platform, the Golden Captain will earn an additional Reward of USDT 3 for said Acquired User. This Reward is earned only once per Acquired User upon verification of their first Valid Transaction and does not accumulate for subsequent transactions by the same user, unless El Dorado stipulates otherwise for a specific period.

For the purposes of this Program, a Valid Transaction is considered any operation effectively completed and settled by the Acquired User within the Platform, including but not limited to:

  • Remittances or transfers between corridors enabled by El Dorado (including, but not limited to, Brazil–Bolivia corridors in both directions).
  • P2P or Express operations.
  • Visa prepaid card payments.
  • QR code payments.
  • Sending or receiving funds via ACH or Wire in USD accounts.

Canceled, failed, reversed, or pending transactions will not be considered valid for Program purposes. El Dorado reserves the right to define, adjust, or restrict the types of eligible transactions, as well as to require a minimum amount per operation, communicating this through the Platform.

9. Reward Amounts

For the current period, the Reward amounts are as follows:

  • Per verified Acquired User registration: USDT 1.
  • Per first Valid Transaction of the Acquired User: An additional USDT 3. The amounts are configurable and may be modified as established in Section 3 of these Terms and Conditions.

10. Payment and Settlement of Rewards

Rewards will be earned and settled on a monthly basis, according to the following rules:

  • Computation Period: Rewards earned by the Golden Captain between the first (1st) and the last calendar day of each month will be tallied.
  • Payment Date: El Dorado will pay the earned Rewards within the first five (5) calendar days of the month immediately following the Settlement Period.
  • Method of Payment: Rewards will be credited to the Golden Captain's account within the El Dorado Platform, in USD or its equivalent in USDT, at El Dorado's discretion.
  • Conditions for Payment: For settlement to proceed, the Golden Captain must maintain their account active, verified, and without restrictions at the time of payment, and must have complied with these Terms and Conditions at all times.

When the fifth (5th) calendar day coincides with a non-business day, payment may be made on the immediately following business day without giving rise to any claim. El Dorado may withhold, in whole or in part, the payment of Rewards corresponding to a Settlement Period when there are signs of fraud, abuse, non-compliance, or when internal reviews or information requests are underway, until the situation is resolved.

11. Program Limits

El Dorado may establish maximum Reward caps, whether per Golden Captain, per Acquired User, per Settlement Period, or globally for the Program. Once the applicable cap is reached, El Dorado may temporarily suspend the assignment of new Rewards until the start of the next period, without giving rise to any claim.

12. Obligations and Conduct of the Golden Captain

The Golden Captain agrees to:

  • Promote the Platform in an ethical, truthful, and respectful manner, without making false or misleading statements that could lead potential Acquired Users into error.
  • Refrain from promising returns, benefits, or services other than those effectively offered by the Platform.
  • Not use El Dorado's brand, logos, materials, or name without prior written authorization, except for those materials officially provided by El Dorado for Program purposes.
  • Not engage in spamming, mass sending of unsolicited communications, or any conduct contrary to consumer protection, personal data, and electronic communication laws.
  • Not engage in self-acquisition, creation of false accounts, identity theft, system manipulation, use of bots, or any other fraudulent or abusive conduct.
  • Comply with the legislation applicable in their jurisdiction, including tax obligations, prevention of money laundering and terrorist financing, and personal data protection.

Non-compliance with any of these obligations may result in suspension, exclusion from the Program, revocation of earned Rewards, and/or corresponding legal actions.

13. Fraud Prevention and Misuse

El Dorado reserves the right to:

  • Suspend, cancel, or revoke Rewards when it identifies or detects objective signs or has reasonable grounds to consider the existence of fraudulent, abusive activities or activities contrary to good faith, including but not limited to: self-acquisition, creation of false accounts, identity theft, use of third-party information without authorization, or system manipulation.
  • Exclude Golden Captains who violate these Terms or any applicable internal policy from the Program, either temporarily or permanently.
  • Request additional information or documentation from the Golden Captain to prove the legitimacy of the acquisitions made. Unjustified refusal or delay in providing such information may lead to the suspension of Reward payments.
  • Request the reimbursement of unduly received Rewards, without prejudice to corresponding legal actions.

14. Non-Transferability of Rewards

Rewards granted under the Program are personal and non-transferable. They may not be assigned, sold, exchanged, or transferred, in whole or in part, to third parties under any title. Any attempt to transfer or misuse Rewards may result in their revocation and, if applicable, the exclusion of the Golden Captain from the Program.

15. Personal Data Processing

The processing of the personal data of Golden Captains and Acquired Users will be governed by El Dorado's Privacy and Personal Data Processing Policy, available on the Platform. The Golden Captain agrees not to collect, store, transfer, or process personal data of Acquired Users for purposes other than those of the Program, and to refrain from using them for their own commercial purposes or those of third parties.

16. Applicable Law and Jurisdiction

These Terms and Conditions of the Golden Captains Program shall be governed by and construed in accordance with the laws of the jurisdiction of Panama.

17. Dispute Resolution

Should a dispute arise between the Golden Captain and El Dorado regarding this Program, it shall be submitted to the procedure established in the general terms and conditions of the Platform.

18. Petitions, Complaints, Claims, and Suggestions

The Golden Captain may submit petitions, complaints, claims, disputes, or suggestions related to the Program through the service channels enabled by El Dorado. Requests must be sent clearly and with the necessary information to allow for proper review. If additional information is required, El Dorado will communicate this to the Golden Captain in a timely manner. El Dorado will review each request in good faith and provide a response within fifteen (15) business days following its receipt. The submission of a claim does not suspend the application of these Terms and Conditions or the general conditions of the Platform.

21. Modifications and Cancellations

El Dorado reserves the power to make adjustments or modifications to this Program, or to suspend it temporarily or permanently, in the event of operational, commercial, or regulatory circumstances that justify it. In such situations, efforts will be made to inform participants in a timely manner through the Platform or registered contact channels. Rewards earned prior to the effective date of modification or cancellation, and which are duly credited according to these Terms and Conditions, will be paid according to the rules in force at the time they were earned.
